General Terms and Conditions and consumer information in connection with pur-chase contracts for Downloadable Music, Video and Image files on this Website between SMP - StRANGe Music Productions  - hereinafter referred to as "Seller" - 

and the customer, hereinafter referred to as "Customer". Since the seller sells his products worldwide, all information on this Website is in English. 

These General Terms and Conditions are part of the purchase contract. 

§ 1 Note on Language in our Terms and Conditions

For the sake of readability, these Terms and Conditions deliberately avoid gender-specific language. All references to men and women apply equally.

§ 2 Scope and General

(1) Subject to overriding individual agreements and arrangements, the following General Terms and Conditions apply exclusively. Unless otherwise agreed, the inclusion of the cus-tomer's own conditions is contradicted.

(2) The customer is a consumer if they conclude the contract for purposes that are predom-inantly neither commercial nor self-employed. On the other hand, an entrepreneur is any natural or legal person or a partnership with legal capacity 

who, when concluding a legal transaction, acts in the exercise of their commercial 

or selfemployed professional activity.

§ 3 Order, Conclusion of Contract 

(1) A purchase contract is concluded by ordering Downloadable Music, Video and 

Image files or an Audio CD in the seller’s Shop on this Website. 

(2) The contract is concluded between the seller and the customer.

(3) If the customer intentionally violates a rule of these terms and conditions when placing an order, no contract will be concluded.

§ 4 Subject of the Contract, Quality, Warranty, Release Dates, Availability

 (1) The subject of the contract are the Downloadable Music, Video and Image files 

or an Audio CD, which the customer purchases at the final prices stated in the respective offers. The seller reserves the right to make errors in this regard. 

(2) All offers by the seller represent a non-binding invitation to the customer to purchase a Download of a Digital Medium or an Audio CD.

(3) The type of  the Downloadable Music, Video and Image files or Audio CD offered 

is specified in the respective product description. The seller assumes no liability for the accuracy of the information in the product descriptions.

(4) Information on release dates and availability of the Downloadable Music, Video and    Image files or Audio CDs can change at any time. The seller assumes no liabili-ty for this.

§ 5 Types of Digital Files for Download, Converting MP3 / WAV files  

(1) We offer the following digital files for Download: 

- Music as mp3 files, 

- Music Videos as mp4 files, 

- Images as jpg files. 

(2) Customers can order the conversion of mp3 files to wav files or the conversion 

of wav files to mp3 files in our Shop for a fee.  

 § 6 Payment, Currency

(1) The purchased Downloadable Music, Video and Image files or Audio CD must 

be paid for by the customer immediately after ordering. 

(2) For Payments we accept PayPal or Credit Card.

(3) The purchased Downloadable Music, Video and Image files are available for 

Download to the customer immediately after full payment has been made. 

(4) All prices are stated and payable in Euro (€). 

§ 7 Shipping costs when ordering an Audio CD, Return Costs,  Return after Cancellation of the Contract   

(1) When purchasing an Audio CD, the customer must pay shipping costs in addi-

tion to the purchase price.

(2) Shipping costs depend on the delivery location.

(3) The shipping costs are generally within Germany: €1.80 (max. 2 Audio CDs), 

for all other countries in the world €3.70 (max. 2 Audio CDs).

(4) The delivery time for an ordered Audio CD is generally 5-21 days, depending 

on the customer's place of residence.

(5) Shipping is from Germany. The seller use Deutsche Post exclusively as his shipping service provider.

(6) The shipping service provider is responsible for the delivery time of the order. The seller has no influence over this. 

(7) Any complaints regarding delivery times or damaged items or packaging must 

be addressed directly by the customer to the shipping service provider. The same applies to lost items. 

(8) The seller does not provide compensation for items lost while in the care of the shipping service provider.

(9) The customer is responsible for the return costs of an Audio CD after he has withdrawn the contract within the specified timeframe.

(10) Once we have received the Audio CD back, the customer will receive a refund 

of the purchase price, less the shipping costs. However, this only applies if the Au-

dio CD case has not been opened and the seal is not damaged. 

§ 8 Warranty for Download Defects

(1) The seller is not liable for defects in the Downloadable Music, Video and Image files that are due to an inadequate internet connection or operating errors by the buyer during the Download. 

§ 9 Instant Download Item

Instantly download Music, Video and Image files cannot be returned, exchanged or cancelled.

§ 10  Cancellation of the purchase contract by the customer

If the customer cancels the purchase contract for the Downloadable Music, Video and Image files within the deadline, he will immediately receive the purchase price already paid back from the seller if the Download of the Downloadable Music, Video and Image files has not yet taken place. 

§ 11 Retention of Title

The delivered Downloadable Music, Video or Image files and Audio CDs  remain the 

property of the seller until full payment has been made. 

§ 12 Licensing of Downloadable Digital Cover Image files after Download

(1) The Content of the Downloadable Digital Cover Image files is the original work 

of SMP, which owns all rights there to.

(2) SMP has all necessary rights to license the content to the customer. No other person or company has the right to control the content.

(3) SMP grants the customer a non-exclusive and perpetual license to use the content as follows:

a.) The customer has the right to use the Digital Cover Image file for personal, non-commercial purposes, such as making copies for personal use, on a personal website, and any other use for which no compensation is paid for the use of the Digital Cover Image file itself.

b.) The customer may incorporate the Digital Cover Image file into a new work and modify the Digital Cover Image file for these purposes, provided that the resulting work is not used commercially by the customer.

c.) If the Digital Cover Image files to be used on a website, the customer has the right to use the Digital Cover Image  files on any number of websites owned personally by the customer. Further use requires licensing from SoundScribe Verlag TF. 

(4) The customer may not use the Digital Cover Image files to advertise a product or commercial enture.

(5) The customer may not transfer or sell the Digital Cover Image files to a third party for use free of  charge.

(6) Any use of the Digital Cover  Image files that does not comply with an exception un-der paragraph 2 (a.) to (c.) will be prosecuted under criminal and civil law.

§ 13 Liability

The legal regulations apply.

§ 14 Publication of the General Terms and Conditions

(1) The general terms and conditions of the seller are published on his website.

(2) The customer can read the General Terms and Conditions (GTC) there at any 

time.

§ 15 Customer Declaration

By completing the purchase, the customer declares that he has read and understood the seller's general terms and conditions, the information on possible cancellation of the contract and the seller's data protection declaration and that he accepts these in their currently valid version without restriction. The customer also acknowledges that the general terms and conditions form an integral part of the purchase contract.

§ 16 Licensing Requests

Licensing Requests for SMP's Music and Video Productions should be made through SoundScribe Verlag TF. 

§ 17 Final Provisions

(1) The language of the contract shall be English. 

(2) The laws of the Federal Republic of Germany shall apply to contracts  between 

the seller and the customer. 

(3) The civil court located at the seller's registered office in Berlin,  Germany, shall have jurisdiction over all disputes arising from  contractual relationships between the customer and the seller. (End of  Terms and Conditions)
