General terms and conditions and consumer information of StRANGe Music Productions 

(SMP) for the purchase of Downloadable Digital Media Content (Music, Video & Image) 

in the StRANGe Music Productions Online Shop on this Website.

General Terms and Conditions (GTC) and consumer information in connection with pur-

chase contracts for Downloadable Digital Media Content (Music, Videos and Images)

on this Website between StRANGe Music Productions (SMP) - hereinafter referred to as 

"Seller" - and the customer, hereinafter referred to as "Customer". Since the seller sells 

his products worldwide, all information on this Website is in English. 

These General Terms and Conditions are part of the purchase contract. 

§ 1 Scope and General

(1) Subject to overriding individual agreements and arrangements, the following General Terms and Conditions (GTC) apply exclusively. Unless otherwise agreed, the inclusion of 

the customer's own conditions is contradicted.

(2) The customer is a consumer if they conclude the contract for purposes that are predom-inantly neither commercial nor self-employed. On the other hand, an entrepreneur is any natural or legal person or a partnership with legal capacity who, when concluding a legal transaction, acts in the exercise of their commercial or selfemployed professional activity.

§ 2 Order, Conclusion of Contract 

(1) A purchase contract is concluded by ordering a Download of a Digital Medium (Music, Video or Image) in the seller’s Shop on this Website. 

(2) The contract is concluded between the seller and the customer.

(3) If the customer intentionally violates a rule of these terms and conditions when pla-

cing an order, no contract will be concluded.

§ 3 Subject of the Contract, Quality, Warranty,Release Dates, Availability

 (1) The subject of the contract is the Download of a Digital Medium, which the customer purchases at the final prices stated in the respective offers. The seller reserves the right to make errors in this regard. 

(2) All offers by the seller represent a non-binding invitation to the customer to purchase 

a Download of a Digital Medium.

(3) The type of Digital Medium Download offered is specified in the respective product des-cription. The seller assumes no liability for the accuracy of the information in the product descriptions.

(4) Information on release dates and availability of a Download of a Digital Medium can change at any time. The seller assumes no liability for this. 

 § 4 Payment, Currency

(1) The purchased Digital Media Content DVD must be paid for by the customer immedia-

tely after ordering. 

(2) For Payments we accept PayPal or Credit Card.

(3) The purchased Digital Media Content is available for Download to the customer im-

mediately after full payment has been made. 

(4) All prices are stated and payable in Euro (€). 

§ 5 Warranty for Download Defects

(1) The seller is not liable for defects in the Digital Media Download that are due to an inadequate internet connection or operating errors by the buyer during the Download. 

§ 6 Instant Download Item

Instant Download Digital Media cannot be returned, exchanged or cancelled.

§ 7  Cancellation of the purchase contract by the customer

If the customer cancels the purchase contract for an Digital Media Download within 

the deadline, he will immediately receive the purchase price already paid back from the 

seller if the Download of the digital media content has not yet taken place. 

§ 8 Retention of Title

The delivered Digital Media Content remain the property of the seller until full payment 

has been made. 

§ 9 Licensing of a Digital Picture file (Cover) after Download

(1) The Content of the Digital Picture file (Cover) is the original work of StRANGe Music 

Productions (SMP), which owns all rights there to.

(2) StRANGe Music Productions(SMP)  has all necessary rights to license the content to 

the customer. No other person or company has the right to control the content.

(3) StRANGe Music Productions (SMP) grants the customer a non-exclusive and perpetu-

al license to use the content as follows:

a.) The customer has the right to use the Digital Picture file for personal, non-commer-

cial purposes, such as making copies for personal use, on a personal website, and any 

other use for which no compensation is paid for the use of the Digital Picture file itself.

b.) The customer may incorporate the Digital Picture file into a new work and modify 

the Digital Picture file for these purposes, provided that the resulting work is not used 

commercially by the customer.

c.) If the Digital Picture file is to be used on a website, the customer has the right to use 

the Digital Picture file on any number of websites owned personally by the customer.

(4) The customer may not use the Digital Picture file to advertise a product or commer-

cial enture.

(5) The customer may not transfer or sell the Digital Picture file to a third party for use 

free of charge.

(6) Any use of the Digital Picture file that does not comply with an exception under para-

graph 2 (a.) to (c.) will be prosecuted under criminal and civil law.

§ 10 Liability

The legal regulations apply.

§ 11 Publication of the General Terms and Conditions

(1) The general terms and conditions of the seller are published on his website.

(2) The customer can read the General Terms and Conditions (GTC) there at any time.

§ 12 Customer Declaration

By completing the purchase, the customer declares that he has read and understood the seller's general terms and conditions, the information on possible cancellation of the con-

tract and the seller's data protection declaration and that he accepts these in their cur-

rently valid version without restriction. The customer also acknowledges that the gene-

ral terms and conditions form an integral part of the purchase contract.

§ 13 Final Provisions

(1) The language of the contract shall be English. 

(2) The laws of the Federal Republic of Germany shall apply to contracts  between the sel-

ler and the customer. 

(3) The civil court located at the seller's registered office in Berlin,  Germany, shall have jurisdiction over all disputes arising from  contractual relationships between the custo-

mer and the seller.
