General Terms and Conditions (GTC) and consumer information in connection with pur-

chase contracts for downloadable digital content (Music, Music-Video and Picture) pur-

chased on this website between StRANGe Music Digital Media -StRANGe Music Produc-

tions - hereinafter referred to as "Seller" - and the customer, hereinafter referred to as 

"Customer". As we sell our products worldwide, all information on our website is in Eng-

lish.

These terms and conditions are part of the purchase contract.

§ 1 Scope and General

(1) Subject to overriding individual agreements and arrangements, the following General Terms and Conditions (GTC) apply exclusively. Unless otherwise agreed, the inclusion of 

the customer's own conditions is contradicted.

(2) The customer is a consumer if they conclude the contract for purposes that are predom-inantly neither commercial nor self-employed. On the other hand, an entrepreneur is any natural or legal person or a partnership with legal capacity who, when concluding a legal transaction, acts in the exercise of their commercial or selfemployed professional activity.

§ 2 Order, Conclusion of Contract 

(1) A purchase contract is concluded by ordering a Download of a digital medium in the 

seller's shop.

(2) The contract is concluded between the seller and the customer.

§ 3 Subject of the contract, quality, warranty, release dates, availability

(1) The subject of the contract is a Download of a digital medium that the customer pur-

chases at the final prices stated in the respective offers. The seller reserves the right to 

make errors in this regard.

(2) All Downloads of a digital medium offered by the seller represent a non-bin-ding in- vitation to the customer to purchase a Download of a digital medium.

(3) The type of the Download of a digital medium offered is stated in the respective pro-

duct description. The seller assumes no liability for the accuracy of the information in 

the product descriptions. 

(4) Information on release dates and availability of a Download of a digital medium can 

change at any time. The seller assumes no liability for this.

§ 4 Payment, Currency 

(1) The digital medium content purchased is available for download to the customer immediately after full payment.

(2) The prices are stated and payable in euros (€).

§ 5 Warranty for Download Defects

(1) The seller is not liable for defects in the digital medium that are due to an inadequate internet connection or operating errors by the buyer during the Download.

§ 6 Instant download item

Instant download digital media cannot be returned, exchanged or cancelled.

§ 7 Retention of title

The delivered digital medium content remains the property of the seller until the total 

amount has been paid in full.

§ 8 Licensing of digital music, video files and pictures (covers)  after download

(1) The content of the digital medium is the original work of StRANGe Music Productions, which owns all rights there to.

(2) StRANGe Music Productions has all necessary rights to license the content to the buyer. 

No other person or company has the right to control the content.

(3) StRANGe Music Productions grants the buyer a non-exclusive and perpetual license to 

use the content as follows:

a.) The buyer has the right to use the digital medium file for personal, non-commer-

cial purposes, such as making copies for personal use, on a personal website, and any 

other use for which no compensation is paid for the use of the digital medium file itself.

b.) The buyer may incorporate the digital medium file into a new work and modify 

the digital medium file for these purposes, provided that the resulting work is not used 

commercially by the buyer.

c.) If the digital medium file is to be used on a website, the buyer has the right to use 

the digital medium file on any number of websites owned personally by the buyer.

(4) The buyer may not use the digital mmedium file to advertise a product or commercial 

enture.

(5) The buyer may not transfer or sell the digital medium file to a third party for use free 

of charge.

(6) Any use of the digital medium file that does not comply with an exception under para-

graph 2(a.) to (c.) will be prosecuted under criminal and civil law.

§ 9 Liability

The legal regulations apply.

§ 10 Publication of the General Terms and Conditions

(1) The general terms and conditions of the seller are published on his website.

(2) The customer can read the General Terms and Conditions (GTC) there at any time.

§ 11 Customer Declaration

By completing the purchase, the customer declares that he has read and understood the seller's general terms and conditions, the information on possible cancellation of the con-

tract and the seller's data protection declaration and that he accepts these in their current-

ly valid version without restriction. The customer also acknowledges that the general terms and conditions form an integral part of the purchase contract.

§ 12 Final Provisions

(1) The language of the contract shall be English. 

(2) The laws of the Federal Republic of Germany shall apply to contracts  between the seller and the customer. 

(3) The civil court located at the seller's registered office in Berlin,  Germany shall have jurisdiction over all disputes arising from  contractual relationships between the customer
